Mayor Paustian called the meeting to order at 6:00 pm. The assembly joined in the Pledge of Allegiance and was welcomed to the meeting.
Agenda: CM Harris moved to approve the agenda as written, seconded by CM Augustyn. Vote taken and motion carried with 5 ayes.
Minutes: CM Kelley moved to approve the regular minutes for November 5, 2019, seconded by CM Whitworth. Vote taken and motion carried with 5 ayes.
Consideration of Claims: Mayor Paustian presented the vouchers for approval. CM Whitworth moved to approve the Considerations of Claims in the amount of $504,026.79, seconded by CM Kelley. Tri-City Parks and Rec – Final Pool Report: Madison Tretter thanked the Council for a fun and safe summer for Guernsey Swimmers. Tri-City employed 20 employees which allowed them to stay open through Labor Day. Swimming lessons were well attended and lots of great comments about the lessons and the staff have been received. Tri-City Parks returned $6,035.14 to the Town for a refund on their original contract amount.
WMPA Representative Appointment: CM Whitworth moved to appoint Joe Michaels as the Town of Guernsey’s Wyoming Municipal Power Associations Representative for 3 years, seconded by CM Kelley. Vote taken and motion carried with 5 ayes.
Resolution 2019-020 – Capital Facilities CD: CM Augustyn moved to approve resolution 2019-020, Capital Facilities CD, seconded by CM Harris. Vote taken and motion carried with 5 ayes.
Resolution 2019-021 – Budget Amendment: CM Whitworth moved to approve resolution 201-021, Budget Amendment, seconded by CM Kelley. Vote taken and motion carried with 5 ayes.
Ordinance 2019-008 – Water Rates:  CM Whitworth moved to approve ordinance 2019-008 Water Rates on third and final reading with the amendment to remove the designation of the Guernsey Sunrise School as a separate user and move them into a Commercial user, seconded by CM Augustyn. Vote taken and motion carried with 5 ayes. Ordinance follows in entirety: AN ORDINANCE AMENDING ORDINANCE 2016-005 PERTAINING TO WATER RATES FOR RESIDENTIAL, COMMERCIAL AND INDUSTRIAL USERS IN THE TOWN OF GUERNSEY, WYOMING. BE IT ORDAINED BY THE TOWN COUNCIL OF GUERNSEY, PLATTE COUNTY WYOMING:
Ordinance No. 2016-005 is hereby amended to read as follows:
Each water user shall pay to the Town of Guernsey the following monthly rates and charges:
•    Residential Units (Individual):
•    First 9,000 gallons or any portion thereof        $30.00/month
•    9,001 to 50,000 gallons or any portion             thereof $1.00/thousand gallons
•    50,001 to 100,000 gallons or any portion
    thereof $1.50/thousand gallons

•    100,001 to 150,000 gallons or any portion         thereof $1.75/thousand gallons
•    150,001 to 200,000 gallons or any portion         thereof $2.00/thousand gallons
•    200,001 gallons and above $2.50/thousand         gallons
•    Apartment Complexes and Trailer Courts         (Per Unit):
•    First 9,000 gallons or any portion thereof        $30.00/month
•    9,001 gallons and above shall be the same         as Residential Rates
•    Commercial:
•    First 9,000 gallons or any portion thereof        $30.00/month
•    9,001 to 50,000 gallons or any portion             thereof $1.00/thousand gallons
•    50,001 to 100,000 gallons or any portion         thereof $1.50/thousand gallons
•    100,001 to 150,000 gallons or any portion         thereof $1.75/thousand gallons
•    150,001 to 200,000 gallons or any portion         thereof $2.00/thousand gallons
•    200,001 gallons and above $2.50/thousand         gallons
•    Industrial:
•    First 17,500 gallons or any portion thereof        $90.00/month
•    17,501 gallons and above                $3.00/thousand gallons
•    Use of Water Outside Town Limits:
•    Water users residing outside the Town limits for the Town of Guernsey shall pay Residential or Commercial rates.
This Ordinance shall become effective on the 1st day of December 2019.
Ordinance 2019-009 – Utility Disconnect: CM Augustyn moved to ordinance 2019-009 Utility Disconnect on third and final reading, seconded by CM Harris. Vote taken and motion carried with 5 ayes. Ordinance follows in entirety: AN ORDINANCE REPLACING ORDINANCE 08-07-002 PERTAINING TO CHAPTER 8, SECTION 8-7: DUE DATE FOR MONTHLY UTILITY CHARGES; DELINQUENT ACCOUNTS AND RECONNECTION FEES. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF GUERNSEY, WYOMING THAT THE CODE OF THE TOWN OF GUERNSEY BE AMENDED, AS FOLLOWS:
All charges for water, sanitation, sewer and electrical services and all related charges shall be due and payable at the office of the town clerk on the 20th day of each month following use.  Any account not paid in full by the 25th day of each month shall be deemed delinquent and will be assessed a late fee of $35.00, in addition, the town shall have the right to terminate all services until such time as all delinquent accounts are paid in full.  In the event of termination of any services the user shall pay the total outstanding balance on the account in addition to a reconnection fee of fifty dollars ($50.00).  Any deposit on account will be applied to the outstanding balance and an additional deposit of seventy-five dollars ($75.00) will be required before any services are resumed.  Electric meter may be pulled without further notice if delinquencies occur.
If your check is returned as a delinquency payment, the Town of Guernsey will consider the account unpaid and your services will be disconnected without further notice.  A return check fee of thirty-five dollars ($35.00) must be paid in addition to the unpaid balance before your services can be restored.  
All other provisions of Ordinance 87-4-1 Adopting the Code of the Town of Guernsey shall remain in full force and effect.
This Ordinance shall become effective on the 1st day of December 2019.

Ordinance 2019-010 – Utility Deposit: CM Harris moved to approve ordinance2019-010 Utility Deposit on third and final reading, seconded by CM Whitworth. Vote taken and motion carried with 5 ayes. Ordinance follows in entirety: AN ORDINANCE REPLACING ORDINANCE 08-1-5 PERTAINING TO CHAPTER 8, SECTION 8-1: DEPOSITS FOR UTILITY SERVICE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF GUERNSEY, WYOMING THAT THE CODE OF THE TOWN OF GUERNSEY BE AMENDED, AS FOLLOWS:
All deposits establishing services with the Town of Guernsey shall be one hundred fifty-dollar ($150.00).
This deposit will be returned upon termination of all utility services and payment of all charges due to the town for anything whatsoever. In the event any amounts are due and owing the town for anything whatsoever, the charges shall first be deducted from any deposit so held by the town and the balance refunded to the consumer.
Deposits that are in effect prior to December 1, 2019 shall be grandfathered in at their original deposit rate. If at any time the resident moves or become delinquent with the town, the one hundred fifty-dollar ($150.00) deposit will be required.
This Ordinance shall become effective on the 1st day of December 2019

Ordinance 2019-011 – Franchise for IntTec: CM Kelley moved to approve resolution 2019-011 Franchise Agreement with IntTec on third and final reading, seconded by CM Harris. Vote taken and motion carried with 4 ayes. AN ORDINANCE GRANTING A FRANCHISE TO INTTEC, INC. TO INSTALL, OPERATE, AND MAINTAIN A FIBER OPTIC COMMUNICATIONS SYSTEM IN THE TOWN OF GUERNSEY, WYOMING RIGHTS-OF-WAY, SETTING FORTH CONDITIONS ACCOMPANYING THE GRANT OF THE FRANCHISE; PROVIDING FOR REGULATION AND USE OF THE SYSTEM; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS.
Proposed Policy & Procedure Manual Amendment: CM Augustyn moved to approve the amended Purchase Policy and Procedures on November 19, 2019, seconded by CM Harris. Vote taken and motion carried with 5 ayes.
Public Comment: Shawna Reichardt reported that they are still working on the umbrella entity with Platte County Chamber and Platte County Economic Development. A program called Shop Your Heart Out will reward citizens for shopping in Platte County. Starting December 1st, they are starting Charlie the Chamber Elf. They will take him around member businesses and post a picture on social media and the first person to guess the correct business will win a Pride Certificate. Shawna said she would like to pursue bringing in small manufacturing businesses into Platte County and could be very beneficial. Lt. Colo. Patton reported that the ribbon cutting for December 4th has been moved to March 2020.
Department Reports: Chief VanDam reported that Officer Gilmore will be leaving November 22nd. The display on camp was a big hit and the Guernsey Police Department was very well received. CM Augustyn asked the Chief to post some dog leash laws along the walking path to prevent citizens from being bit. Operation Warm Hands will be starting soon, hats, gloves, coats, scarves and any other winter items can be donated. CM Whitworth moved to purchase a fire truck from Laramie County Fire District #2 for $20,000, seconded by CM Harris. Vote taken and motion carried with 5 ayes. The Council agreed to sell engine 1 to Fire Truck Certification for $3,000. Kate reported that the roof at the golf course has been installed. The Town was approved for $2,063,600 from the Wyoming Water Development Commission in a grant for the water transmission line project. The Golf Course Well House bid opening will be December 3rd and a contractor will be recommended to the Council that evening. We will no longer be able to dump the grass clipping from the green dumpsters at the brush pile by the landfill. Kate has contacted TDS to get a quote to haul the clippings to the TDS landfill. When she has that information, she will share it with the Council. Joe Michaels reported that WMPA is comprised of 8 member towns. The agency generates power from Laramie River Station and Dry Forks Station. Basin just spent $300 million to upgrades the Laramie River Station. The agency has 3 to 5 meg of Hydro reserves but is a little low on renewables. He doesn’t see the stations going out of business any time soon.
Mayor and Council Reports: CM Augustyn was approached by the school to have the Mayor and Council come speak to students about the Town and what the Council does. CM Harris congratulated Mr. Reichardt on his award. Mayor Paustian thanked the staff for all the work they have done.
