Mayor Delgado called the meeting to order at 6:00 pm. The assembly joined in the Pledge of Allegiance and was welcomed to the meeting.

Agenda: CM Whitworth moved to approve the agenda, seconded by CM Harris. Vote taken and motion carried with 3 ayes.

Minutes: CM Harris moved to approve the minutes as presented, seconded by CM Whitworth. Vote taken and motion carried with 3 ayes.

Consideration of Claims: Mayor Delgado presented the vouchers to approval. CMWhitworthmoved to approve the Considerations of Claims in the amount of $214,983.89, seconded by CM Harris. Vote taken and motion carried with 3 ayes. Ordinance 2018-001 – Uniform Act Regulating Traffic on Highways – 3rd& FinalReading: CM Whitworth moved to approve Ordinance 2018-001 on second reading, seconded by CM Harris. Vote taken and motion carried with 3 ayes. Ordinance follows in entirety: AN ORDINANCE ADOPTING THE UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS: BE IT ORDAINED BY THE TOWN OF GUERNSEY, WYOMING:

Ordinance 2018-001 is hereby created to read as follows:

SECTION 1: ADOPTION

The Uniform Act Regulating Traffic on Highways in Title 31, Wyoming Statutes, 1977, as amended, is hereby adopted in its entirety, as applicable, and:

W.S. §24-1-110 Exhibition of Acceleration
W.S. §31-4-101 Vehicle Registration
W.S. §31-4-103 Compulsory Auto Insurance
W.S. §31-7-110 Instruction and Temporary Driver’s Permit
W.S. §31-7-116 Carrying and Displaying
W.S. §31-7-117 Restricted Licenses

W.S. §31-7-133 Unlawful Use of License
W.S. §31-7-135 Permitting Unlicensed Person to Drive
W.S. §6-3-107 Throwing Burning Substance from Vehicle; Penalties

SECTION 2: REPEALER CLAUSE

All other ordinances, resolutions or by-laws, or parts of any ordinances, resolutions or by-laws in conflict with this ordinance are hereby repealed.

SECTION 3: SEVERABILITY

If any section, paragraph, clause or provision of this ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such part shall not affect any of the remaining provisions of this ordinance.

SECTION 4: EFFECTIVE DATE

This ordinance shall be in full force and effect from and after its passage, approval and publication.

Ordinance 2018-002 – Compression Brake –3rd& FinalReading: CM Harris moved to approve Ordinance 2018-002 on second reading, seconded by CM Whitworth. Vote taken and motion carried with 3 ayes. Ordinance follows in entirety: AN ORDINANCE RELATING TO THE USE OF COMPRESSION BRAKES WITHIN THE TOWN OF GUERNSEY. BE IT ORDAINED BY THE TOWN OF GUERNSEY, WYOMING:

Ordinance 2018-002 is hereby enacted to read as follows:

SECTION 1: Definitions

a. ENGINE COMPRESSION BRAKE – any motor vehicle brake that is operated by the compression of the engine of the motor vehicle or any unit or part thereof.  An engine compression brake is also referred to as a “Jake brake”.

SECTION 2: Use of Compression Brakes

No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of such motor vehicle or any unit or part thereof within the corporate limits of the Town of Guernsey. 

SECTION 3: Penalty for Violation

Violation of this ordinance by any person is hereby declared to be a misdemeanor and upon conviction shall be fined in an amount not to exceed $100.00, plus costs. Violation of this ordinance shall be deemed a separate offense on each day that a violation shall occur.

SECTION 4: REPEALER CLAUSE

Banner Health Ambulance Service – Aubrey Bremer: Aubrey spoke to the Council about the national standards that Banner is held to, meeting and exceeding. Response times while the ambulance service was volunteer based were 11.35 minutes and since Banner took it over they are now 9.18 minutes. The on-scene times were 33 minutes for the volunteers and 17 minutes for Banner Ambulance. Guernsey currently only has 1 EMT and 1 driver living within the Town limits.  Shane Clevenger spoke to Banner and the Council and expressed that he lost his EMT license because of not having a medical director. He wasn’t able to hire on with Banner as he had other priorities. Aubrey let him know that it is a per diem positions that would work with his schedule and if he was interested he should apply. Jeff Thomas expressed that the ambulances have left Guernsey and that was not in the original discussion and they have been seen in other municipalities. The ambulances are used where they are needed to cover all of Platte County when necessary. He also complained about the response time to a wreck on Hwy 270 and Kerry Campbell reported that the first crew was on scene within 15 minutes, with Sharon Holloway being there first and the ambulances were there in 35 minutes after the call came into dispatch.

Department Reports: Kate Farmer reported that the Financial Review is complete and will be given to the Council at the next meeting. It has also been sent to the State as required by statute. The new diving board was received 2 weeks ago and was damaged and the shipment was rejected. The new diving board is scheduled to be delivered on Thursday. The Mayor, Kate and Kathy will be attending the WAM Conference in February. The Utility Billing Clerk position is open for applications and will close on February 9, 2018. Interviews will start the next week so that the new employee can get necessary training before Mary leaves. Kate presented a bid to upgrade the website to a new company with better usability. The Council would like to have a presentation of the new company. Kate said she would set up the presentation for the next meeting. Kate and the Mayor attended the County Commissioners meeting for the Specific Purpose Tax. There will be 3 ballot initiatives; County Courthouse remodel for $14 million, Fair Board 4-H remodel for $4 million, and the 5 municipalities for infrastructure projects at $10.5 million. The final numbers are needed by the first of February and then the County can pass a resolution to put it on the ballot. The municipalities will also have to pass a resolution to have it included on the ballot.

Sarah Cowan reported that the letters in support of the daycare are ready to be sent to the Governors’ office. There will be a meeting for Guernsey Economic Development on Saturday, January 20th at 9 am in at First State Bank. The Public Hearing for the Master Trail Plan will be on January 23rd in Town Hall at 6 pm.

Matt Allred presented his report to the Council. Mayor Delgado ask if the house on S. Dakota had the trees cut down? Matt will get another letter sent out this week. The Mayor expressed that we may need to get a lien put on it if we have to take care of the trees.

Shenna Thomas reported that they just got back from Fire School. Rescue 4 is still at the shop and should be done soon. A few calls for the smell of gas when they started their furnaces up but nothing to worry about.

Chief Dwight McGuire reported 378 calls for service in December. Officer Smith is at the academy and pass his PT today and has passed all his tests that he has taken. Officer VanDam completed her FTO training and will be training the Guernsey PD.

Mayor& Council Reports: CM Harris thanked the citizens that did attend the meeting with their concerns of the ambulance service. He would have liked to see the additional citizens that had complaints to come to the meeting and make their concerns known. The Mayor reiterated what CM Harris said about the ambulance and attending the meetings. Mayor Delgado thanked Kate Farmer, Matt Allred and Mike Montgomery for getting the numbers and projects put together to take to the County Commissioners. He also thanked Aubrey Bremer and Kerry Campbell for coming and reporting on the ambulance service. The Mayor thanked Misty Clevenger for posting the meeting to Facebook and trying to get more people to attend the meeting.
